Telo AI, Inc. (“Telo,” “we,” “us,” or “our”) is committed to protecting the privacy of all individuals who interact with our products and services, including students, educators, clinicians, parents, and website visitors. This Privacy Policy explains how we collect, use, disclose, and safeguard your information across our educational robots, teacher dashboards, web applications, therapeutic tools, and associated services (the “Services”).

By accessing or using our Services, you agree to this Privacy Policy and to our Terms of Service. If you do not agree, you must not use our Services.

1. INFORMATION WE COLLECT

We collect both “Personal Information” and “Non-Personal Information.”

“Personal Information” includes:

  • Name and email address of educators, clinicians, and/or parents
  • Student or client identifiers (e.g., anonymized user ID, school-issued ID, or clinic ID)
  • Educational and therapeutic records, including lesson progress, performance data, behavioral data, and IEP-related or care plan metrics
  • Voice inputs used for educational or therapeutic interactions
  • Information subject to FERPA or HIPAA protections, such as cognitive or emotional assessment indicators

“Non-Personal Information” includes:

  • Device information (browser, operating system, IP address)
  • Usage data (session duration, clicks, interaction logs)
  • Attention tracking metrics (e.g., focus detection, touch sensors)

2. HOW WE COLLECT INFORMATION

Through User Interaction: We collect data when users interact with our robots, dashboards, and online services. This includes registration details, lesson activity, and sensory engagement (e.g., touches, gaze, or speech).

Through Technology: We use cookies and analytics tools to collect data about user behavior and service performance. We do not use cookies to serve targeted advertising.

3. CHILDREN’S PRIVACY (COPPA COMPLIANCE)

Telo complies with the Children’s Online Privacy Protection Act (COPPA). We do not knowingly collect Personal Information from children under 13 without prior verifiable consent from a parent, school, or licensed clinician. Schools and clinics act on behalf of parents under FERPA or HIPAA guidelines when using Telo in an authorized setting. Parents and guardians may request access to, review, or delete their child’s data by contacting us at privacy@mytelo.ai.

4. HOW WE USE AND SHARE INFORMATION

We use Personal Information to:

  • Provide adaptive educational and therapeutic experiences
  • Monitor learning or behavioral progress
  • Fulfill contractual obligations with schools, clinics, or therapy providers
  • Improve our content and platform through aggregated insights

We may share information with:

  • Authorized school or clinic personnel
  • Service providers operating under strict data privacy agreements
  • Legal authorities when required by law

We do not sell or rent Personal Information to third parties.

5. DATA SECURITY

We employ industry-standard technical and organizational measures to protect data, including:

  • End-to-end encryption
  • Role-based access controls
  • HIPAA- and FERPA-compliant data storage
  • Secure hosting on U.S.-based infrastructure

While we strive to maintain high security, no system is fully immune to breaches. We will notify affected parties as required by law in the event of a data breach.

6. YOUR RIGHTS

Parents, guardians, clinicians, and schools may:

  • Access data associated with a student or client
  • Request corrections
  • Request deletion of data, subject to legal and contractual limits

7. DATA RETENTION

We retain Personal Information only as long as necessary to fulfill the purposes stated herein or as required by law. Upon termination of services or receipt of a verified request, we will delete or de-identify data in a timely manner, unless required to retain it under applicable education or healthcare regulations.

8. COMPLIANCE WITH FERPA, COPPA, AND HIPAA

Telo complies with the Family Educational Rights and Privacy Act (FERPA), the Children’s Online Privacy Protection Act (COPPA), and the Health Insurance Portability and Accountability Act (HIPAA) as applicable. We may enter into a Data Processing Agreement (DPA) with educational institutions or a Business Associate Agreement (BAA) with covered entities when handling educational records or Protected Health Information (PHI). Please contact us to request a copy of the relevant agreement.

9. CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time. Significant changes will be communicated through the Services or via email and will become effective 30 days after notice. Continued use of the Services after changes constitutes acceptance of the revised terms.
